Major Victory for Delivery Workers: Landmark Protections Took Effect in NYC

Department of Consumer and Worker Protection (DCWP) celebrated the effective date of key amendments to the City’s Delivery Worker Laws that went into effect on January 26, 2026. The new laws strengthen rights for delivery workers, including increasing pay transparency, expanding minimum pay rate to cover third-party grocery delivery workers, improving bathroom access, and requiring restaurant and grocery apps to offer a tipping option at checkout. DCWP also announced today that it secured more than $5 million in worker restitution and penalties from Uber Eats, Fantuan, and HungryPanda and directed Uber to reinstate close to 10,000 workers.
Since DCWP began enforcing the minimum pay rate in 2023, workers have taken home an additional $1.2 billion in earnings. If you do delivery work for restaurant apps (e.g., DoorDash); grocery apps (e.g., Instacart), or other delivery service apps (e.g., Amazon Flex), read DCWP’s multilingual Notice of Rights.
